These terms and conditions (the "Terms and Conditions") are the terms and conditions upon which Maples Flowers ("we/us") make this website (the "Maples Flowers Site") available to you. 
These Terms and Conditions govern your use of the Maples Flowers Site. 

1. Products 
1.1 All products as depicted on this website (as may be varied from time to time) are available for local delivery only. 
1.2 Certain flower and plant products may be delivered in bud to ensure longer life. 
1.3 All products are subject to availability. In the event of any supply difficulties, we reserve the right to substitute with a product of equivalent value and quality without notice. 
1.4 In the event that we are unable to supply all or part of your order (the product or any substitute product to you at all), we shall notify you as soon as possible and reimburse your payment in full no later than 30 days after the intended delivery date. 
1.5 Products on the Maples Flowers website are not available for same day delivery. Please contact us on 01442 800812 for this service. 

2. Prices 
2.1 Prices listed within the Maples Flowers website are valid for a maximum of 14 days from the day or ordering, but are subject to change during peak periods and to accommodate the seasonal availability of some flowers. 
2.2 Prices include VAT at the prevailing rate set by customs and excise. 
2.3 Product prices exclude the local delivery charge. The charge for your selected delivery area can be viewed in the delivery info section of the site. 
2.4 We reserve the right to change without notice, the price, or prices of any, or all products listed on the Maples Flowers website. 

3. Orders / Payment 
3.1 During the order process, you will be required to provide us with your complete personal details, including accurate postcode, together with those of the intended recipient and all necessary payment details. 
3.2 We accept payment by all major credit and/or debit cards using the Worldpay payment gateway. You are not required to have an account with Worldpay to be able to make a payment using a credit and/or debit card. Worldpay will make the secure transaction between your bank and ours. 
3.3 By clicking on the 'check out' button at the end of the order process, you are consenting to be bound by our terms and conditions contained in these Terms and Conditions and appearing anywhere on the Maples Flowers site. 
3.4 Submitting your order is subject to our acceptance of this offer. We will send an email confirmation of your order details to advise that we are processing your order via the email address you provide. We will not consider ourselves bound by a contract with you until we have issued this email confirmation. 

4. Delivery 
4.1 Except where stated, Standard Delivery is next day or as requested at the time of your order. A local delivery is anywhere in the county of Hertfordshire and charged at £4.95. A regional delivery is anywhere in the county of Bedfordshire and Buckinghamshire and will be charged at £7.95. Certain locations will be charged at a slightly higher or lower amount than stated depending upon distance from the store. 
4.2 Selected products are not available for delivery to certain areas - where possible we will advise you of these restrictions before you place your order. 
4.3 Delivery Services - Should you require your delivery to be made same day or within a specific time period please call 01442 800812 to place your order to confirm the details. 
4.4 We may process orders received on Sundays or Public Holidays the next working day. 
4.5 Delivery is not available on Sundays or public holidays, orders will be delivered on the next working day. 
4.6 To avoid problems or delays with delivery, please ensure that you have included the full address details, including accurate postcode of the intended recipient and telephone number, together with your daytime contact telephone number or e-mail address so that we can notify you in the event that any delivery problems are encountered. 
4.7 In the case of delivery to certain locations, where a third party is involved, such as offices, hospitals, Funeral Directors, wedding venues and other business locations, the signature or verbal receipt of any person authorised to accept delivery on behalf of the organisation/individual shall be accepted as proof and acceptance of delivery to your chosen recipient or location. 
4.8 Please note that the Maples Flowers is only responsible for delivering to the address you quote (or to a neighbour if no one is at home) we regret that where the goods have been correctly delivered we cannot accept responsibility if the intended recipient has moved, or lives elsewhere, and the actual receiver refuses or fails to return item(s). 
4.9 Where the delivery driver is unable to find someone to accept delivery they will deliver to a neighbour, leave in a secure location or leave a card at the address for the recipient to make contact. 
4.10 In the instance of there being difficulties in delivering your order to the intended recipient we reserve the right to contact the recipient using the contact details you provide at the time of placing your order. 
4.11 Before placing your order, please review delivery information & prices. 
4.12 When promotions are run that include "Free Local Delivery", the local area is considered by Maples Flowers as anywhere within a 20 mile radius of our postcode HP3 9SB. A delivery charge will be applied if the delivery address falls outside of this area. 
4.13 Our bouquet delivery service is only available for destinations within Bedfordshire, Hertfordshire and Buckinghamshire of the UK, for deliveries to other areas of the UK please call the shop on 01442 800812 where we will be able to take your order and use our relay service to complete the order. 
4.14 Maples Flowers accepts no responsibility for the delivery of flowers carried out by our relay services and will refer you to their terms and conditions for more information. 

5. Cancellation Of Bouquet Orders 
5.1 Orders may be amended or cancelled up to 3 working days before the intended delivery date. 
5.2 To amend or cancel your order, please contact Maples Flowers from 8:30am until 5:30pm Monday to Friday and 8:30am until 5pm on Saturday using the contact details set out in Section 6 below. 
5.3 Orders may not canceled on or after the requested order delivery date.

6.2 Because of the perishable nature of most products and in order to assist us in resolving any complaints quickly and to our mutual satisfaction, we advise you to make any complaint within 1 working day of the date of delivery or intended delivery of your purchase. 

7. Disclaimer 
Whilst we agree to use all reasonable endeavours to ensure that the Maples Flowers site is fully operational and error-free we cannot guarantee this and, therefore, accept no responsibility for any defects and/or interruption of the Maples Flowers Site and shall be released from our obligations under these Terms and Conditions in the event of any cause beyond our reasonable control which renders the provision of the Maples Flowers Site impossible or impractical. 

8. General Refunds And Returns Policy 
8.1 A full refund will be given on bouquets and orders that do not match their description when the product(s) have been returned to Maples Flowers. We will also cover the expense of having the products returned (i.e you receive the wrong bouquet, we will fully refund the order when the incorrect bouquet has been returned or collected by our delivery team). 
8.2 A partial refund will be made for items or services that have only been partially completed. (i.e if your bouquet should have included a box of chocolates but didn't, we can refund you for the box of chocolates). Arrangements that include many types of flowers will only be partially refunded for the flowers that may be missing from the arrangement. 
8.3 To make us aware of your intention for a full or partial refund you will need to make contact with us within 24 hours of receiving the goods or services. 
8.4 Wedding and funeral flowers can only be fully refunded if you notify Maples Flowers as soon as you notice there is an issue with your delivery. If the flowers are used at the service/event and no notification has been made to Maples Flowers before it starts, then a partial refund will be negotiated following the service/event based on the irregularities of the order. By using the flowers for your event you are accepting the order in its current state.

9. General 
9.1 We reserve the right to supplement and amend the Terms and Conditions on which you are permitted access to the Maples Flowers Site and/or the Maples Flowers delivery service from time to time. We will post any changes on the Maples Flowers Site and it is your responsibility as a customer to review the Terms and Conditions on each occasion you access the Maples Flowers Site. Changes will be effective immediately after the posting of any such change and all subsequent dealings between you and us shall be on the new terms and conditions. 
9.2 Additionally, we reserve the right to suspend, restrict or terminate access to the Maples Flowers Site at any time. 
9.3 We shall ensure that we comply with the requirement of all current data protection legislation including, without limitation, the Data Protection Act 1998 (as replaced, modified or re-enacted from time to time). We shall only use personal data received from you for the purpose of fulfilling our obligations under these Terms and Conditions and as stated in our Privacy Policy. 
9.4 A person who is not a party to the agreement between you and us has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of the Terms and Conditions but this does not affect any right or remedy which exists apart from that Act. 
9.5 In respect of fraudulent misrepresentation, this agreement (including any documents and instruments referred to herein) supersedes all prior representations, arrangements, understandings, and agreements between you and us (whether written or oral) and sets forth the entire agreement and understanding between you and us relating to the subject matter hereof. 
9.6 Your purchase will be deemed to have occurred in the UK. These Terms and Conditions shall be governed by and construed in accordance with English Law and the parties agree to submit to the exclusive jurisdiction of the English courts. 

10. Wedding Bookings and Booking Fees  
10.1 A £100.00 Non Refundable Booking Fee is required at the time of booking and is an agreement between you and us (whether written or oral) 
10.2 Full payment is due one month before the wedding date unless stated in your contract at the time of booking. 
10.3 Any cancellations made within 30 days of the booked event, the booking fee and 50% of the final balance will be required. 
10.4 Any cancellations within 14 days of the booked event, the booking fee and 100% of the final balance will be required. 
10.5 Any postponement of the event made within 30 days of the booked event date, the booking fee and 50% of the final balance will be required to move the order to a future date (subject to availability). 

11. Hired Goods 
11.1 You are solely responsible for the Hired Goods not the reception / event venue / hotel or any other third party to whom you have entrusted the Hire Goods. You alone shall be responsible for ensuring the Hired Goods are kept in good order from the time of despatch from Maples Flowers until back into the possession of Maples Flowers. Therefore, if you intend to leave Hired Goods anywhere other than in your possession before or after the event an agreement of a good provision of storage must be made and organised direct with the hotel or third party by yourself and does so at your own risk.  
11.2 You should understand that Maples Flowers items are in good working order but are not in “as new” condition. Once the hired items have left our premises  we deem the hire period to have begun and the hire items satisfactory and fit for purpose. We will NOT entertain complaints made after the items have been returned.  
11.3 You will be required to pay for any non-returns, damaged goods or breakages howsoever caused at full retail value. Details of the retail value of Hired Goods will be given on request at the time of booking for the Client’s own information.
